Sports Planet – Tipping & Competitions - General Terms & Conditions



Sports Planet and First Tips are the promoters of the tipping competitions conducted on the sportsplanet.com.au and firsttips.com.au websites. Although participants may enter the competitions on either site, the competitions are not seperate. For the sake of clarity, and for example, there is only one 2010 football tipping competition conducted for both Sports Planet and First Tips, and therefore only one winner. The Sports Planet and First Tips competitions are not seperate competitions.

 

Registration is free. Registration is limited to one per person.

 

Prizes will only be issued to a participant who’s details match the details submitted on the registration form.

 

Registration is restricted to only those of 18 years of age and above. As a condition of Registration, the Participant’s Date of Birth will be required to be disclosed. If a Participant fails to disclose their Date of Birth, they will be unable to register into any Competition. If a Participant discloses an incorrect Date of Birth at the time of registration, and at the time of registration the Participant is officially under 18 years of age, the Participant will not be eligible to collect any prizes, and their entry into any  tipping competition will be void.

 

By completing a valid registration once, a person is eligible to participate in any or all the tipping competitions conducted by Sports Planet.

 

Each tipping competition has its own supplementary Terms and Conditions, and by submitting tips in a competition, the participant agrees to be also bound by those Terms and Conditions.

 

By completing a registration, a person agrees to receive emails from Sports Planet. If a person does not wish to receive email notifications from Sports Planet they can request so by emailing their username along with "unsubscribe" to info@sportsplanet.com.au, or clicking unsubscribe at the bottom of any email sent by Sports Planet.

 

Sports Planet reserves the right to amend the Terms and Conditions at any time. Notification of a change to the Terms and Conditions will be published at sportsplanet.com.au.

 

 

Football Tipping 2010 – Terms and Conditions

 

Registration for entry into this Competition conducted on this Web Site is free.

 

In these Terms & Conditions of Entry, the following words have the following meanings, unless anything to the contrary intention appears.

 

 “Away Team” means the team that is listed by the Australian Football League (AFL) as playing away from their home ground. If the AFL does not nominate an Away Team, the Away Team will be nominated at the discretion of the Promoter and will be posted on the Web Site

 

"Match" means a single game conducted by the AFL, between its member teams.

 

"Participant" means a person who is eligible to participate and registers for or participates in this Competition by logging into the Web Site with their username and password.

 

"Competition" means the tipping competition made available on the Web Site, for the Season of Matches conducted by the AFL.  Winning entries are based on the Results of Matches at the conclusion of the relevant Round or Season.

 

"Results" are the results or outcomes of Matches following the completion of a Round, as officially determined by the AFL in accordance with the rules of the AFL

 

"Round" means an official round of the AFL conducted during its Season that is made available for tipping as outlined on the website.

 

“Season” means the series of home and away games (or series of Matches as indicated otherwise on the Web Site) for the AFL as listed on the Web Site. The Promoter has decided that the Season will not contain the finals series.

"Score" means the allocation of points to a Participant for the correct selection of a Match as defined by the website.

 

“Promoter” means Firsttips.com.au

 

“Website” means all pages within the Firsttips.com.au and Sportsplanet.com.au domains.

 

Information on how to register, enter, scoring and prizes as posted on the Web Site form part of these Terms & Conditions of Entry. Therefore failure to comply with these Terms & Conditions of Entry will result in Participants being ineligible to enter the Competition. The Promoter reserves its absolute right to disqualify any Participant from the Competition if any entries do not comply with these Terms & Conditions of Entry. Entry into any Promotion is deemed to constitute acceptance of these Terms & Conditions.

 

Entry into this Competition is restricted to only those of 18 years of age and above. As a condition of entry into the Competition, the Participant’s Date of Birth will be required to be disclosed. If a Participant fails to disclose their Date of Birth, they will be unable to register into the Competition. If a Participant discloses an incorrect Date of Birth at the time of registration, and at the time of registration the Participant is officially under 18 years of age, the Participant will not be eligible to collect any prizes, and their entry into a tipping competition will be void.

 

The Competition is open to residents of Australia (and other countries where the law allows residents to enter Completions’ of this nature).

 

The Promoter highlights that Employees of the Promoter and its agencies associated with this Competition and their immediate families are ineligible to enter.

 

An individual may only register once to be a Participant in this Competition. Eligibility for prizes is therefore restricted to the individual only registering as a Participant once and therefore may only place one set of tips per Round of the AFL. The Promoter reserves the right, in its sole discretion, to verify the Identity of the Participant. In the event that individual is found to have registered more than once as a Participant the Promoter reserves the right to refuse to grant prizes.

 

Entry into the Competition conducted on this Web Site is available up until the closing submission time for tips in Round 17. Registration for entry into this Competition thereon will not be allowed.

 

In the event that a Participant enters the Competition after the commencement of Round 1, but before the commencement of Round 17, in compliance with the condition set out directly above, then the Participant will be allocated the current accumulative lowest Score held by the lowest ranked Participant.

 

The Promoter reserves the right not to accept registration from any Participant if the registration contains anything slanderous or defamatory or is unsightly in any way. This includes any form of profanity as determined by the Promoter in its absolute discretion. The Promoter will ask the Participant to rectify any such situations and in the event that the Participant does not oblige with the Promoter’s requests, the Promoter will withdraw the Participant’s registration from this Competition. The Promoter reserves the right to cancel any registration by a Participant due to unsightly conduct at any time during and after the Promotion. This includes any registration that the Promoter reasonable suspects have been created using a computerised scripting tool.  

 

To enter the AFL tipping Competition, a Participant must make a selection of the teams the Participant tips to win. The provision to tip a draw isn’t available. Thus, in the event that a Match is drawn, no score will be allocated to the Participant’s total.

 

Participants will be allocated one (1) point towards their Score for each correct result selection of a Match. In the event of a Match in a given Round being cancelled, abandoned, not completed or not played for any reason and/or a Result is not officially declared within three (4) days of the date the Match was originally scheduled to be played, it is treated as a draw.

 

If a Participant does not submit their tips for a given Match or Matches, including all matches in that Round, they will be given a default tip, being the Away team for that Round. Consequently if the Away Team wins that Match or Matches, then the Participant will be awarded one (1) point for each Match.

 

A Participant will be allowed to log in and submit their tips for a round 24 hours after the completion of the previous round  and up to two (2) hours before the first scheduled Match of the round. The scheduled Match start time is the official start time specified by the AFL. Participants who login within 2 hours of the first match of the round start time will not be able to submit any tips. To allow those participants who login just before the cutoff time the opportunity to submit their tips, the system is set to allow a 15 minute buffer after the scheduled cutoff time. Participants are advised that if their tips aren’t submitted within the buffer time, the tips page will refresh automatically, causing them to lose the opportunity to submit their tips. The buffer period does not give a participant the opportunity to login. First Tips/ Sports Planet will not be responsible for the non submission of tips by a participant under any circumstances.

 

Participants will be ranked by their Score, where the highest Score has the highest rank.

 

The following Round of Matches will be available for tip selection twenty four (24) hours after the completion of the final game of the previous Round.

 

The end of Season rankings will be determined by the Participant’s total Score for all Rounds. In the case of a tie, Participants will then be ranked by those who achieved the most perfect scores for individual rounds.  Then, in the case of a further tie, the Participants will be invited to participate in a Grand Final playoff where they will need to pick the winner of the Grand Final and the total match points. The participant who correctly picks the Grand Final winner will be the tipping competition winner. In the event that 2 or more tipsters select the Grand Final winner, the tipster who’s total match score prediction is closest (over or under) will be deemed the winner. Further details regarding any Grand Final playoff will be released if a playoff is necessary.

 

End of Season rankings will be determined no later than 72 hours after the final Round of the Season has been completed.

 

Prizes and their values are as set out on the Web Site. The Promoter reserves the right to increase, but not decrease, the value of these Prizes at their own discretion.

 

Those Participants who achieve a Rank of one (1), two (2) and three (3) will be considered Season place winners and the recipient’s of the allocated prizes. In the event that there is still a tie for the positions after a Grand Final playoff, the tied participants will share the prize pool. As an example, if 2 Participants tie for first place, even after any playoff, they will split first and second prize evenly. In ant event, the total prizes paid out cannot exceed the total prize pool which is currently $1200AUD (One Thousand Two Hundred Dollars AUD).

 

The Promoter reserves the right to issue weekly prize(s) to Participant(s). The rationale, extent, and value of these prizes will be at the sole discretion of the Promoter.

 

All prize winners will be notified by email and will be published on the Promoter’s Web Site upon determination. The Promoter will require the postal address of any winning Participant, for the purpose of claiming their prize.

 

In the event that a prize winning Participant is unable to accept their prize for whatever reason, or the prize is unable to be allocated, within four (4) months of the results being determined, the Promoter will then award that prize to the Participant who met the eligibility criteria and would have been deemed the prize winner had the original prize winning Participant not participated in the Promotion

The Promoter reserves the right, at any time, to verify the validity of registrations and site activity and the eligibility of applicants and Participants (including an applicant’s or Participant’s identity, age and place of residence) and to disqualify any Participant who submits a registration, tip, or any other information on the site that is not in accordance with these Terms and Conditions of Entry or who tampers with the registration or any processes of the website

 

At any stage, the failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.

 

Except for any liability that is bound by law, the Promoter and its agencies associated with this Promotion (including their respective officers, employees and agents) are not liable and do not accept responsibility for:

 

A Participant's tips that are not received or which are received and subsequently corrupted or rejected by the Web Site server whether or not after receipt by the Promoter

 

b)         Any lost, misdirected or corrupt tips to the Web Site

 

c)         The Website not being continuously available for use

 

d)         Any loss or damage whatsoever or any personal injury suffered or sustained in connection with a Participant’s participation in the conduct of the Promotion. This includes failure of the Web Site or incorrect or corrupt data supplied by the Promoter to a Participant

 

e)         Any theft, unauthorised access or third party interference;

 

f)          Any variation in the value of any prize

 

g)         Any tax liability incurred by a Participant or prize winner.

 

As a condition of accepting any prize, the Promoter advises that the winner must sign any legal documentation in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

 

Information collected about Participants is used by the Promoter to assess and process registration in the Competition. If an applicant does not provide the required information, then the Promoter cannot process the registration. All entries will be entered into a database and are the property of the Promoter. Information derived from the Participant's participation in the Competition is used by the Promoter and its agencies associated with this Competition for the determination of winners and distribution of prizes. Participants consent to publishing their name and Score in the results section of the Web Site and as otherwise set out in these Terms and Condition of Entry.

 

The Promoter will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant's tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. Information about Participants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail, telemarketing and promotional campaigns unless a Participant otherwise withdraws their consent to the use of their information in this manner.

 

The Promoter will act in accordance with its Privacy Policy  regarding personal information supplied by entrants when entering this Competition. If you have any queries regarding the Privacy Policy, please visit the website for more information. This is because entry in this Competition is an agreement to be bound by that policy. If an entrant wishes to have their details removed from the Promoter’s database, they can do so by contacting the Promoter. If details are removed prior to the conclusion of the Competition and/or award of prize(s), entrants will forfeit their right to claim any prizes.

The Promoter will not be liable for any legal action that is the result of any Participant’s name or postings on the Web Site being slanderous, defamatory or unsightly to the public at large, except for any liability that cannot be excluded by law. By participating in the Promotion, the Participant agrees to indemnify the Promoter, its agents, contractors and related companies from any legal action, claim or dispute arising in relation thereto.

 

The Promoter is not liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained as a result of taking a prize, except for any liability which cannot be excluded by law.

 

The use of any automated entry software or any other mechanical or electronic means that permits any person to enter the Competition repeatedly is prohibited and all Participants or entries submitted reasonable suspected of originating from a Participant engaging in such practices will be terminated at the discretion of the Promoter.

 

By entering this Competition all entrants:

a)         assign to the Promoter all rights including present and future copyright in their entry and the publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future;

b)         agree not to assert any moral rights in respect of their entry and the publicity materials (wherever and whenever such rights are recognised) against the Promoter, its assigns licensees and successors in title;

 

A failure by the Promoter to enforce any one of these terms and conditions in any instance(s) will not give rise to any claim or right of action by any other person or Participant.

 

Participants agree to receive email notifications from the Promoter, such as, but not limited to, confirmation of their submitted tips for a round. If a participant wishes not to receive emails from First Tips, they can do so by writing to First Tips at info@sportsplanet.com.au

 

The Promoter reserves the right to update terms and conditions and make changes if the situation arises. Notification of any change to these Terms and Conditions will be made on the website.

 

In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.

WORLD CUP TIPPING 2010

"Results" are the results or outcomes of Matches fo as officially determined by FIFA in accordance with the rules of the FIFA.

To enter the FIFA World Cup Competition, a Participant must make a selection as follows:

  • For the Round Robin Groups Stage: The Participant must select the team they tip to win or a draw.
  • From thereon, during the Knockout Phases, The Participant will select the team they tip to progress through to the next round. This will occur up until the World Cup Final, where the Participant will tip the team to win the World Cup.
  • Knockout Phases include the 2nd round matches, Quarter Final Matches and Semi Finals Matches.

Participants will be allocated one (1) point towards their Score for each correct result selection of a Match.

Participants will be ranked by their Score, where the highest Score has the highest rank.

The final rankings at the completion of the Competition will be determined no later than 72 hours after the final of the tournament.

Prizes and their values are as set out on the Web Site. The Promoter reserves the right to increase, but not decrease, the value of these Prizes at their own discretion.

Prizes are as follows:

1st - $1500AUD

2nd - $500AUD

3rd - $250AUD

4th to 20th - $50AUD Sports Store Voucher

Those Participants who achieve a Rank of one (1), to (20) will be considered Competition place winners and the recipient’s of the allocated prizes. In the event that there is still a tie for the positions, the tied participants will share the prize pool. As an example, if 2 Participants tie for first place, even after any playoff, they will split first and second prize evenly. In ant event, the total prizes paid out cannot exceed the total prize pool which is $3100AUD (Three Thousand One Hundred Dollars AUD).

Registration for entry into this Competition conducted on this Web Site is free.

 "Competition" means the tipping competition made available on the Web Site, for the Australian A-League.  Winning entries are based on the Results of Matches.

"Match" means a single game played during the regular season, between A-League teams.

"Participant" means a person who is eligible to participate and registers for or participates in this Competition by logging into the Web Site with their username and password.

"Results" are the results or outcomes of Matches as officially determined by the FFA in accordance with the rules of the FFA.

 "Round" means an official round of the A League conducted during its Season that is made available for tipping as outlined on the website

"Score" means the allocation of points to a Participant for the correct selection of a Match as defined by the website.

 

“Promoter” means Sportsplanet.com.au

Information on how to register, enter, scoring and prizes as posted on the Web Site form part of these Terms & Conditions of Entry. In ant event, the total prizes paid out cannot exceed the total prize pool which is $1750AUD (One Thousand Seven Hundred And Fifty Dollars AUD).

All prize winners will be notified by email and will be published on the Promoter’s Web Site upon determination. The Promoter will require the postal address of any winning Participant, for the purpose of claiming their prize.

In the event that a prize winning Participant is unable to accept their prize for whatever reason, or the prize is unable to be allocated, within four (4) months of the results being determined, the Promoter will then award that prize to the Participant who met the eligibility criteria and would have been deemed the prize winner had the original prize winning Participant not participated in the Promotion

The Promoter reserves the right, at any time, to verify the validity of registrations and site activity and the eligibility of applicants and Participants (including an applicant’s or Participant’s identity, age and place of residence) and to disqualify any Participant who submits a registration, tip, or any other information on the site that is not in accordance with these Terms and Conditions of Entry or who tampers with the registration or any processes of the website.

Cash 4 Clubs – Sub Competition

  1. Participants are able to, if they wish, choose a club that they wish to support in the separate “Cash 4 Clubs” competition. The “Cash 4 Clubs” competition is a separate competition aimed at helping local soccer clubs raise money, and therefore individual tippers are not eligible to win any prize offered in this sub competition. However, individuals can help a chosen club by allowing their points to be pooled with all other supporters of that club to try and win first prize for their chosen club in the “Cash 4 Clubs” competition.  Supporting a club does not decrease your chance of winning the individual tipping competition, and you will not lose any points you have won by doing so. Club selection closes 6th September 2010.
  2. “Cash 4 Clubs” is only open to nominated clubs. Entry is free.
  3. Individuals can only select a club up until the 6th September 2010. Selecting a club after this date will not be possible.
  4. Once a club has been selected by an individual, it cannot be changed.
  5. Clubs will accumulate points based on the points won by their supporters in the individual tipping competition.
  6. Any game tip that has been submitted by an individual before the individual has selected a club will not count towards the clubs accumulated total.
  7. To be eligible for a prize, a club must have accumulated a minimum of 50 points by the end of the competition.
  8. Prizes are as follows:
    1. 1st Prize - $3000AUD
    2. 2nd Prize - $1000AUD
    3. 3rd and 4th Prizes - $500AUD
    4. 5th to 8th Prizes - $250AUD
  9. The total prize pool for this competition is $7000AUD (Seven Thousand Dollars).
  10. In the event of a tie for a prize, the prize will be split using the same methods as used in the individual competition.
  11. The general rules of the competition also apply to this sub competition.

At any stage, the failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.

Except for any liability that is bound by law, the Promoter and its agencies associated with this Promotion (including their respective officers, employees and agents) are not liable and do not accept responsibility for:

 A Participant's tips that are not received or which are received and subsequently corrupted or rejected by the Web Site server whether or not after receipt by the Promoter

 

b)         Any lost, misdirected or corrupt tips to the Web Site

 

c)         The Website not being continuously available for use

 

d)         Any loss or damage whatsoever or any personal injury suffered or sustained in connection with a Participant’s participation in the conduct of the Promotion. This includes failure of the Web Site or incorrect or corrupt data supplied by the Promoter to a Participant

 

e)         Any theft, unauthorised access or third party interference;

 

f)          Any variation in the value of any prize

 

g)         Any tax liability incurred by a Participant or prize winner.

 

As a condition of accepting any prize, the Promoter advises that the winner must sign any legal documentation in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

 

Information collected about Participants is used by the Promoter to assess and process registration in the Competition. If an applicant does not provide the required information, then the Promoter cannot process the registration. All entries will be entered into a database and are the property of the Promoter. Information derived from the Participant's participation in the Competition is used by the Promoter and its agencies associated with this Competition for the determination of winners and distribution of prizes. Participants consent to publishing their name and Score in the results section of the Web Site and as otherwise set out in these Terms and Condition of Entry.

 The Promoter will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant's tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. Information about Participants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail, telemarketing and promotional campaigns unless a Participant otherwise withdraws their consent to the use of their information in this manner.

 

The Promoter will act in accordance with its Privacy Policy regarding personal information supplied by entrants when entering this Competition. If you have any queries regarding the Privacy Policy, please visit the website for more information. This is because entry in this Competition is an agreement to be bound by that policy. If an entrant wishes to have their details removed from the Promoter’s database, they can do so by contacting the Promoter. If details are removed prior to the conclusion of the Competition and/or award of prize(s), entrants will forfeit their right to claim any prizes.

The Promoter will not be liable for any legal action that is the result of any Participant’s name or postings on the Web Site being slanderous, defamatory or unsightly to the public at large, except for any liability that cannot be excluded by law. By participating in the Promotion, the Participant agrees to indemnify the Promoter, its agents, contractors and related companies from any legal action, claim or dispute arising in relation thereto.

 The Promoter is not liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained as a result of taking a prize, except for any liability which cannot be excluded by law.

 The use of any automated entry software or any other mechanical or electronic means that permits any person to enter the Competition repeatedly is prohibited and all Participants or entries submitted reasonable suspected of originating from a Participant engaging in such practices will be terminated at the discretion of the Promoter.

 

By entering this Competition all entrants:

a)         assign to the Promoter all rights including present and future copyright in their entry and the publicity materials in all media (including, without limitation, the internet) and whether in existence now or created in the future;

b)         agree not to assert any moral rights in respect of their entry and the publicity materials (wherever and whenever such rights are recognised) against the Promoter, its assigns licensees and successors in title;

 

A failure by the Promoter to enforce any one of these terms and conditions in any instance(s) will not give rise to any claim or right of action by any other person or Participant.

The Promoter reserves the right to update terms and conditions and make changes if the situation arises. Notification of any change to these Terms and Conditions will be made on the website.

 

In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
